The terms on which Empowering Hearts Support Services Pty Ltd makes this website available, and how they sit alongside a service agreement.

1. These terms
This website at empoweringheartssupportservicestec.site is operated by Empowering Hearts Support Services Pty Ltd (ABN 98 701 324 978, ACN 701 324 978) of VIC 3875, Australia. By accessing or using the site you agree to these terms. If you do not agree with them, please do not use the site.
2. Using this website
You may view, download and print pages from this site for your own use, or to share with a family member, carer or support coordinator. You agree not to:
- Use the site for any unlawful purpose, or in a way that breaches the rights of anyone else.
- Attempt to gain unauthorised access to the site, its hosting environment or any connected system.
- Interfere with the operation or availability of the site, including by introducing malicious code.
- Copy, republish or reproduce substantial parts of the site commercially without our written permission.
- Collect information from the site by automated means for resale or bulk redistribution.
3. Information on the site
The content on this site is general information about the support we provide. It is not clinical, medical, legal or financial advice, and it should not be relied on as a substitute for advice from a qualified professional who knows the individual's circumstances.
We take care to keep the site accurate and current, but we do not warrant that it is complete, error-free or continuously available. Descriptions of services indicate what we can typically provide; what we actually provide to a particular person is what is set out in that person's service agreement.
4. Services and agreements
Nothing on this site is an offer to provide support, and sending us an enquiry does not create a support arrangement. Support is provided only once we have confirmed capacity and both parties have signed a written service agreement covering the tasks, hours, fees, cancellation terms and review arrangements.
Where there is any inconsistency between this website and a signed service agreement, the service agreement prevails.
5. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth). Those guarantees include that services will be supplied with due care and skill, will be fit for any purpose made known to us, and will be supplied within a reasonable time.
If a service we supply fails to meet a consumer guarantee, you are entitled to a remedy under the Australian Consumer Law. For a major failure you may cancel the service and seek a refund for the unused portion, or compensation for the reduction in value, and you may also be entitled to compensation for any other reasonably foreseeable loss or damage. For a failure that is not major, you are entitled to have the problem fixed within a reasonable time, and if that is not done you may cancel the contract and obtain a refund for the unused portion.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law or any other law where to do so would be unlawful.
6. Limitation of liability
Subject to section 5, and to the extent permitted by law:
- We are not liable for any indirect, special or consequential loss, or for loss of profits, revenue, data or opportunity, arising out of your use of this website.
- We are not liable for any loss arising from your reliance on general information published on this site, as opposed to advice given to you directly about your own circumstances.
- We are not liable for interruptions to the site, or for loss caused by matters outside our reasonable control, including hosting failures and communications outages.
- Where our liability may be limited rather than excluded, our liability in relation to the supply of services is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
Our liability is reduced to the extent that any loss is caused or contributed to by you or by someone acting on your behalf.
7. Intellectual property
All content on this site — including text, page structure, layout, graphics, the design of the site and the Empowering Hearts name and marks — is owned by Empowering Hearts Support Services Pty Ltd or used with permission, and is protected by the Copyright Act 1968 (Cth) and other Australian laws.
You may not reproduce, adapt, distribute or commercially exploit that content without our prior written permission, except as permitted by the Copyright Act or expressly allowed in section 2.
8. Third-party links
This site may occasionally refer to external organisations, such as government agencies. Any such reference is provided for convenience. We do not control those organisations and are not responsible for their content, their services or their handling of your information.
9. Privacy
Personal information collected through this site or through an enquiry is handled in accordance with our privacy policy and the Privacy Act 1988 (Cth).
10. Suspension and termination
We may suspend, withdraw or restrict access to all or part of this site at any time, without notice, including for maintenance or where we reasonably believe these terms have been breached. We may also decline to respond to enquiries that are abusive, threatening or vexatious.
Termination or suspension of access to the site does not affect any service agreement in place. Service agreements end according to their own terms, and sections 5 to 7 and 12 of these terms survive any termination.
11. Changes to these terms
We may update these terms from time to time. The version published on this page, with the date shown above, is the one that applies. Continuing to use the site after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of Victoria, Australia, and by the Commonwealth laws that apply there. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and of the courts able to hear appeals from them.
